INTRODUCTORY NOTES
Dalia Villa & Apartments (hereinafter referred to as Dalia) provides accommodation services which are in accordance with the General Terms and Conditions and the confirmation and specification received for each individual reservation. Dalia cannot be held responsible for circumstances which are outside its control, such as armed conflict, terrorism, rebellions or disturbances, strikes, natural disasters and adverse weather conditions, epidemics, prohibitions, restrictions imposed by local government, etc.
1. SUBJECT OF THE CONTRACT
Subject of this contract is regulation of relations between Dalia on one side and the accommodation user (hereinafter referred to as guest) on the other side, during the process of booking the accommodation offered through the web page www.dalia-rabac.com.
2. RESERVATION AND CONCLUSION OF THE CONTRACT
The contract between the guest and Dalia comes into force with the binding reservation (verbally, in writing or by e-mail). From that moment on, the rights and obligations of the contractual parties are regulated by these General Terms and Conditions and apply to Dalia and the guest. Confirmation of reservation will be immediately delivered to the guest by e-mail. Dalia may without obligation accept any kind of special request, but it is not legally binding for Dalia and will be fulfilled only if a written confirmation has been issued.
In case the payment arrangements are not being made according to Article 3.2, the reservation may be cancelled, with no further obligations from Dalia towards the guest.
3. PRICES AND TERMS OF PAYMENT
3.1. Price of the accommodation
Price of the accommodation includes basic service as described in reservation confirmation. Supplemental services are those which are not included in price and are to be extra charged. These services must be requested during the reservation process.
Accommodation prices are in EUR. Dalia holds the right to change published prices. For guests that effectuated the advance payment for a certain reservation, Dalia guarantees the agreed price the advance payment is based upon and stated in the reservation confirmation. Additional services requested by the guest are not included in the price and must be paid on the spot to the person in charge of the facility's keys, or to the owner.
For villa: minimum length of stay is 7 nights. Arrival/departure day is Saturday, unless otherwise specified.
For apartments: minimum length of stay in the high season is 7 nights, and outside the high season 3 nights. Arrival/departure day is according to the mutual agreement.
Accommodation price (unless otherwise specified) includes: WI-FI, usual consumption of electricity and water, final cleaning, linen and bath towels.
3.2 Payment
Regardless the fact that the reservation has been made directly by the guest, or through a partner agency, the guest or agency has to make advance payment within 5 days upon receiving the reservation confirmation, amounting to 20% for villa and 20% for apartments, which definitely confirms the booking. The rest of the payment must be effectuated latest 60 days before arrival and start of using the booked service (i.e. arrival) for villa. For apartments it is possible to effectuate the payment before arrival or upon arrival.
For reservations for villa made within 21 days before arrival the total reservation amount must be paid in the next 24 hours. Payment of reservations made within 21 days before arrival must be re-confirmed by written confirmation (e-mail).
3.3. Reservation cancellation for villa
If the guest cancels the reservation, the following cancellation fees will be charged:
- Reservation cancellation notified more than 45 days before arrival: 30% of the total reservation cost is charged,
- Reservation cancellation notified between 44 and 28 days before arrival: 50% of the total reservation cost is charged,
- Reservation cancellation notified between 27 and 8 days before arrival: 70% of the total reservation cost is charged,
- Reservation cancellation between 7 and 1 day before arrival: 80% of the total reservation cost is charged.
The day when the cancellation notice has been received is considered to be the cancellation date (if it happens to be a holiday or Sunday, it will be the next working day). In case of no-show or unannounced delayed arrival, Dalia keeps the total reservation amount.
If the guest must cancel the reservation before the arrival, Dalia offers the possibility for the guest to find a new guest for the same reservation, if possible. In such case, Dalia shall only charge the actual costs caused by the reservation change. The new reservation user takes over all obligations from these General Terms and Conditions.
3.4. Travel insurance
Dalia advises all its guests to take a travel insurance that covers the case of the reservation cancellation.
4. TIME OF ARRIVAL AND DEPARTURE; SHORTENING OR EXTENDING YOUR STAY
After settling the total reservation cost, travel documents will be delivered to the guest, confirming that he/she is the legitimate user of the booked accommodation. Travel documents include a voucher and accurate information about where to collect the accommodation's keys, after presenting the payment confirmation for the booking.
The guest is asked to pay attention to the contact telephone numbers in order to be able to contact the accommodation's owner or a person in charge of the keys. Upon arrival the guest must hand in their travel and personal documents to the person holding the house/apartment keys, who will then register the guest by the authorities and immediately return their personal documents. The foreseen time of arrival/departure is stated in the travel documents. The foreseen arrival time for villa and apartments is after 4 p.m. Departure time for villa and apartments is latest until 10 a.m. In case the arrival is not possible before 8 p.m., the guest is obligated to notify the owner or person in charge of the keys, with whom they will arrange when to collect the keys.
5. MAXIMAL NUMBER OF PEOPLE
The accommodation units from our offer may only be occupied by the maximal number of persons listed in the description of the reserved accommodation unit described on Dalia`s web pages. The same applies to children, regardless of their age.
It is also forbidden to place tents or caravans on the land belonging to the facility. In case of exceeding the maximum number of persons, or placing a tent or caravan on the facility's land, the owner will remove the extra persons from the estate and demand the removal of the tent or caravan. If the guest ignores the request, everyone will be removed from the estate and no refund will be made.
6. DALIA'S OBLIGATIONS TOWARDS GUESTS
Dalia must constantly strive to ensure the quality of services rendered, in accordance with legal regulations, industry standards and generally accepted tourism, hotelier and catering guidelines and customs.
Dalia will strive to fulfill its obligations as agreed upon, in their entirety, except in case of circumstances outside its control.
7. GUESTS’ OBLIGATIONS
Guests must have all personal documents necessary for checking in and out of Dalia. Guests must comply with the house rules presented for each individual accommodation facility.
Guest must check travel regulations between the Republic of Croatia and the country from which he/she is traveling before arrival. Guests must check whether any additional travel documents are required for his/her entry into and stay in the Republic of Croatia.
The guests are obligated to obey the house rules. Minors must always be accompanied with an adult. Dalia preserves the right to end the contract with an immediate effect if guests do not obey the house rules.
Youth groups and groups of friends are not allowed! Noise is not allowed; villa and apartments are situated in a quiet street!
7.1. Deposit
Upon arrival guests pay a deposit amounting to 200 Eur in cash for villa and 100 Eur in cash for apartments, which is to be stored. The deposit will be returned if there were no damages.
7.2. Pets
Pets are not allowed in villa and in the apartments.
8. DAMAGES
The guest is obliged to settle immediately all costs of damage or loss incurred as a consequence of deliberate or non-deliberate acting caused by the guest or other persons spending their holiday with the guest. The guest's responsibility for damage will be charged in the full damage amount and can be collected within 30 days from the last day of stay.
9. LIABILITIES OF DALIA
Dalia is not liable for loss or damage of personal belongings, nor for injuries, accidents or events with lethal results during the guests’ stay. Guests use all facilities of Dalia at their own risk and responsibility.
10. COURT AUTHORITY
All disputes or disagreements shall be resolved by mutually acceptable agreement, and if a solution cannot be reached, the local competent court in Pula shall arbitrate.
